Division of Sound("Company" "we" "our" or "us") fully respects your right to privacy and provides this privacy policy (this "Privacy Policy") to inform you ("you" "your" "user") of the following practices and procedures regarding our collection, use and disclosure of any information we are provided or that we obtain about users of this website (this "Site") in connection with your use of any part of our service or software (the "Services") by virtue of this Site. Information collected may be stored, processed, accessed, and used in jurisdictions whose privacy laws may be different and less protective than those of your home jurisdiction.

Company reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post, or to remove any information or materials, in whole or in part, at our sole discretion.

This Privacy Policy may be amended or updated from time to time. If we make any material changes to this Privacy Policy, we will post a notice of these changes on our Site and in this Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes.

 

1. Personally Identifiable Information

a) This Privacy Policy only applies to information you provide to us online while visiting or using this Site or the Services, or that we collect as part of the Services. It does not apply to information we have obtained offline or through other traditional means.
b) In order to use this Site and these Services, including gaining access to any music, graphics, photos and sounds (the "Content") offered via this Site, we ask that you become a registered user with the Division of Sound Dashboard (the "DoS Dashboard"). Notwithstanding the above, Company does not require you to become a registered user with the DoS Dashboard for the sole purpose of previewing the Content on a limited basis. The registration procedure asks you to provide information to us, including, but not limited to, your name, email address, username, and date of birth. To fulfill licensing transactions or provide the Services to you as a customer of the DoS Dashboard, we may require you to provide certain additional information to us. Common items may include, but are not limited to, your mailing address, phone number, credit card information, and credit card billing information.
c) By providing this information to Company, you are agreeing to allow us to utilize this information to complete all transactions you request through this Site and to disclose that information and details of all such transactions to Company, our subsidiaries, affiliates, and any necessary payment processors. Because of the nature of the Internet, such data may pass through any country. We follow generally accepted industry standards to help protect your personal information. Any payment made with credit cards will be done through payment gateway provider’s protected pages (SSL). Notwithstanding, there is no guarantee that such practices will prevent the disclosure or further distribution of such data beyond Company.
d) Company also uses your personally identifiable information to communicate with you. Company may send transaction-related communications such as welcome letters, billing reminders, and purchase confirmations. Company may also send you surveys or marketing communications to inform you of new products or services, including those of Division of Sound, Legalize it Licensing, Inc., its divisions and subsidiaries, or other information that may be of interest. If you do not wish to receive marketing communications, you may follow the "unsubscribe" instructions included within each email communication. Please keep in mind that, if you choose not to receive marketing communications, you will continue to receive transactional or account communications.

 

2. Non-Personally Identifiable Information

a)Aggregate Information. This Site gives our users opportunities to submit non-identifiable information concerning the users’ activities at this Site, including, but not limited to, which pages they visit, how long they view these pages, date and time of the visit, ranking of songs, creating playlists, and information that your browser sends whenever you visit any website, such as your computer’s Internet Protocol address, browser type, and the web page you were visiting before you came to this Site, is non personally identifiable information ("Aggregate Information"). This Aggregate Information does not identify a particular user, but does provide potentially useful data concerning our users’ preferences and activities on this Site, and the effectiveness and interest of this Site’s features and Services.
b) By submitting this Aggregate Information, you grant Company a non-exclusive, irrevocable license to use it in any way that does not use or reveal your personal information. In addition, Company reserves the right to use portions of your personal information in an aggregate, non-identifiable way, such as disclosing that there are 5,000 registered users from Miami, Florida.

 

3. Advertisers’ Collection of Information

With Internet technology, it is possible for advertisers, as well as site hosts and other third parties, to collect information through the use of cookies and other technologies, such as so-called "clear GIF" files. We have no control over, and cannot necessarily protect against, the practices or policies of advertisers or other web site hosts using such technologies.

 

4. Information from Minors

This Site is not intended for use by persons under the age eighteen (18). Company does not knowingly collect information from minors but, due to the nature of electronic communication, Company urges parents and caregivers to thoughtfully address how minors communicate electronically to ensure that their personally identifiable information is protected. If Company is informed of or learns that a posting is by a person under the age of eighteen (18), Company will remove that post.

If you choose to visit a third party's site, please be aware that the third party's privacy policy, and not that of Company, will govern your activities and any information you disclose while visiting the third party's site. Interactions you perform with links on this Site may be stored in order to generate statistics about link usage and improve our services.
b) We use third-party advertising companies to serve ads when you visit this Site. These companies may use aggregated information (not including your name, address, email address or telephone number) about your visits to this Site and other websites in order to provide advertisements about goods and services of interest to you. If you have provided us your email address, Company periodically sends promotional emails to its subscribers about services offered by Company and its partners. It is our intention that users may review, update, correct or delete any information provided, if not required to be retained by law or for legitimate business reasons to the extent permitted by law. Users may do so by accessing your DoS Dashboard or by contacting us at contact@divisionofsound.com. Please be sure to clearly indicate your contact and data privacy preferences. We reserve the right to verify the identity of any person making an opt-out or correct/update request, but shall have no liability whatsoever resulting from false or erroneous requests. If you completely delete all such information, your account shall be deactivated. We may charge for such services, and may retain an archived copy of your records as required by law or for legitimate business purposes to the extent permitted by law. In addition, we may delete any information provided by you or related to you, pursuant to our policies as then in effect.

 

11. Protection of Information

a) We make good faith efforts to store information collected from you in a secure operating environment that is not available to the public in order to best protect your personal information from loss, misuse, unauthorized access, disclosure, alteration and destruction. Notwithstanding, and due to the nature of the Internet, we cannot guarantee, and hereby disclaim, assurances of complete security and protection from third parties who, despite our efforts, obtain unauthorized access.

Notwithstanding, there is no guarantee that such practices will prevent the disclosure or further distribution of such data beyond Company.
c) If a password is used to protect your account and personal information, it is your responsibility to keep your password confidential.

 

12. Safe Harbor and Enforcement

Company participates in the Safe Harbor program developed by the U.S. Department of Commerce and the European Union. Company adheres to the U.S. Safe Harbor Privacy Principles of Notice, Choice, Onward Transfer, Security, Data Integrity, Access and Enforcement, and is registered with the U.S. Department of Commerce Safe Harbor List. Company regularly reviews its compliance with the Safe Harbor program. When we receive complaints, which cannot be addressed between Company and the complaining user, we will cooperate with the appropriate regulatory authorities to resolve any complaints regarding the transfer of personal data.
